Successfully defended a contractual sanctions compliance clause in a precedent-setting court case, in which our team represented a Russian subsidiary of a well-known Swedish manufacturer of mining equipment in a claim brought by one of the companies of the UMMC [Ural Mining and Metallurgical Company] group. The subject matter of the dispute was the collection of a contractual penalty charged for the non-delivery of certain equipment manufactured in Europe. The defense developed by our team was based on a sanctions compliance clause in the parties’ contract, according to which the supplier cannot be held liable for breach of the contact and can exit the deal in case of sanctions-related restrictions impeding the delivery.
Represented the interests of the largest Lebanese steel company as a creditor in the bankruptcy case of a Russian steel mill when it was included in the register of creditors' claims based on an LCIA arbitration award.
Negotiated and worked out the terms of out-of-court settlement agreements with one of the largest American technology corporations that supplied equipment and provided technical support for this equipment.
Represented the interests of an IT company in numerous disputes with distributors in connection with the suspension of the provision of technical support services for equipment.
Represented the interests of a franchisor in a bankruptcy case involving a franchisee challenging a commercial concession agreement concluded between them.
Represented the interests of a majority creditor in the bankruptcy case of the former general director of the creditor in the amount of more than RUB 350 million.
Represented a bank beneficiary in a dispute on facing secondary liability in connection with the imputed underestimation of reservation volumes of financial organization.
