Representative Legal Matters
  • Advised a Norwegian real estate company in connection with the sale of its office building of circa 15,000 sqm in Moscow.
  • Advised McCain Foods, the world’s largest manufacturer of frozen food, on investment in and divestment from Russia.
  • Obtained two landmark court decisions supported by the Russian Supreme Court: (1) Helped GHP Russia, a developer of a high-end residential property, to proceed with construction by contesting a local law of St. Petersburg. The courts, including the Supreme Court, held that the law was void. (2) Defended IFSK ARKS, a road construction company, against controlled bankruptcy of subcontractor by setting off the mutual debts. The courts, including the Supreme Court, held that the unilateral set-off was valid.
  • Represented Media Markt, a major retailer of electronic and household appliances, in numerous disputes against the landlords in 8 Russian regions. Defended the client against unjust enrichment claims and rent recovery claims, recovered contractual penalty from a landlord, terminated leases, enforced preliminary leases, ensured timely premises’ surrender.
  • Represented Auchan, a major international FMCG retailer, in a dispute concerning retail premises’ sale and purchase contract. The client and the developer filed mutual claims for contract termination and claimed significant damages (USD 53 million).
  • Defended a Russian real estate holding company from five claims for demolition of its Class A office complex in Moscow. Succeeded in getting the court not only to reject the claims and find that the buildings were built legally but also to reject all of the claimant's motions, including requests for evidence.
  • Advised an investment company on various development projects in Moscow and the Moscow region. Advice included development issues, land issues (allocation and development), issues on residential owners associations, non-profit partnership.
  • Helped a major Russian agricultural company terminate a long-term land lease and recover damages arising from the deterioration of the land plot.
  • On a pro bono basis advised and represented patients under the care of the Russian charity fund SMA Families. Managed to ensure that two children with SMA (spinal muscular atrophy) have started to receive pricey Spinraza treatment from the Russian authorities free of charge. Until we applied to the court on behalf of these children, the authorities had refused to treat them.
