Biography
Nikita Krasniy specialises in representing clients in commercial litigation and handling complex insolvency cases. Nikita has significant experience in sanctions and tort disputes, recognition and enforcement of Russian and foreign court decisions, and preparation of expert reports for courts both in Russia and abroad.
Representative Legal Matters
  • Represented a Russian bank that was a creditor in the bankruptcy proceedings of one of Russia's largest grain processing companies. Successfully achieved the removal of a biased liquidator, protected the debtor from the claims of a heating supply organization amounting to RUB 6 million, and reached an out-of-court settlement regarding controlling persons with secondary liability of RUB 3.2 billion.
  • Represented a liquidator in the bankruptcy proceedings of an oil extraction plant. Comprehensive support in the case resulted in the controlling persons of the debtor being held liable for RUB 3.5 billion and significant replenishment of the bankruptcy estate by recovering multi-million accounts receivable under supply and leasing agreements.
  • Advised a bankrupt Russian bank on arbitration in the LCIA regarding the recovery of damages and indemnity related to agreements made by controlling persons aimed at asset stripping prior to the bankruptcy.
  • Consulted trustees on the recognition of their powers in Italy and Israel. Thanks to joint efforts with foreign attorneys, achieved recognition of Russian bankruptcy proceedings and the powers of trustees for the subsequent sale of expensive foreign real estate owned by the debtors.
  • Prepared an expert opinion for the client on Articles 248.1 and 248.2 of the Arbitrazh Procedural Code of the Russian Federation for use by the High Court of England and Wales, which served as the basis for an anti-suit injunction terminating the ongoing litigation.
  • Represented a German bank in a dispute over the recovery of payments under a guarantee governed by English law and ICC Uniform Rules for Demand Guarantees No. 758.
