Biography

Pavel Novikov is the head of the Bankruptcy & Disputes practice group, and an advocate. Pavel focuses on domestic litigation and international commercial arbitration, specifically on insolvency and restructuring disputes. He represents clients in commercial, corporate and administrative (regulatory) disputes. Pavel also acts on behalf of the clients in criminal investigations and cases.

Representative Legal Matters
  • Represented Codest Engineering Srl, an Italian general contractor, in two litigation proceedings initiated by its counterparty in breach of arbitration clause (ICC, seat in Stockholm) in a construction subcontract.
  • Represented the insolvency administrator of OJSC TKS, Mr. Busygin, in the dispute on bringing PJSC «TGK-2» to the secondary liability.
  • Represented a bankruptcy administrator of a Czech bank and then a foreign company, Gomanold a.s., assignee of the Czech bank, to recover its Russian assets from the Russian debtor and to foreclose upon collateral.
  • Represented Novo Nordisk in the Russian insolvency proceedings of a client’s former distributor.
  • Advised Shell in connection with Mariysky Refinery insolvency.
  • Represented KABOSH Group of Companies, a large Russian food manufacturer, in disputes regarding claw-back of the business reorganization, within which the client consolidated the assets from several companies into the one company.
  • Represented Henkel in the course of litigation proceedings against the client’s distributor to timely recover the debt owed under the contracts and foreclose upon the mortgage.
  • Represented a US largest aviation service provider in the claw-back dispute regarding sale and purchase contracts entered with the bankrupt airline company on the verge of its insolvency.
  • Represented a large multinational company in two LCIA arbitrations against the client’s seller and guarantor in connection with non-delivery of steel products and default under the guarantee.
  • Represented one of the biggest Russian private banks in a US asset tracing project against a Russian citizen.
