Biography
Roman Bilyk specializes in tax law and has more than 20 years of experience in representing major international and Russian businesses in their dealings with tax authorities. Roman is an advocate. Roman has extensive experience in successful defending clients' interests during pre-tax reviews and tax audits, including the preparation of reasonable and documented positions, support of tax control measures, negotiations with tax authorities, as well as administrative and judicial challenge of tax authorities' decisions. He has significant successful experience in the pre-trial settlement of tax disputes. Roman leads projects on tax litigation support, including transfer pricing, as well as advising on complex Russian and international taxation and structuring issues.

  • Advised an international group of companies engaged in the development, publishing and monetization of multiplayer online games, as part of a project to spin off the Russian and Belarusian companies of the group into a separate business unit for independent business development in Russia and Belarus while maintaining control over the main items of intellectual property at the level of the foreign parent company of the group.
  • Advised an international group of companies that manufactures and sells sportswear, footwear and accessories on the development of a position on the applicability of withholding tax, and on the procedure and amount of payment of this tax, in a situation where royalties for the use of intellectual property are included in the price of the goods, and exemption from withholding tax is not available due to the termination of the double taxation agreement between the Russian Federation and the Netherlands.
  • Defended managers of a foreign logistics company in a VAT fraud case.
  • Advised an international manufacturer of computer equipment on the pre-trial settlement of claims with partners and end customers of the company in connection with the suspension of the client’s business operations in Russia and the termination of the supply of products and components to the Russian market. Advised the client on restrictions imposed on the company's activities and interactions with individual partners.
  • Successfully represented many of the Russian subsidiaries of international groups operating in oil and gas, pharma, construction, financial and other industries in pre-tax audit reviews and tax audits on various controversial issues.
  • Successful pre-trial settlement of tax disputes with respect to the deductibility of intercompany services and intercompany financing.
  • Complete dismissal of tax authorities' claims during in-house tax audits on VAT refunds, including successful representation of clients during pre-investigation audits by the internal affairs authorities.
  • Represented a Russian subsidiary of an international oilfield service equipment manufacturer in challenging the cadastral valuation of a number of land plots for the purposes of land tax calculation.
  • Advised a major international producer of electronics and a provider of innovative high-technology services on the tax and transfer pricing structuring of the transfer pricing model for the new business area of technology services in Russia.
  • Development of a transfer pricing model and preparation of transfer pricing documentation for major international and Russian corporations.
