Biography
Anton Maltsev is a partner in the Dispute Resolution practice, an advocate, and holds a Ph.D. in Law. Anton has over fifteen years of experience representing international and Russian clients in major and complex disputes. His practice covers a wide range of industries, including construction, logistics, automotive, heavy industry, oil and gas, and chemicals. In addition to his work as counsel, Anton regularly acts as an arbitrator and is included on the rosters of leading arbitral institutions, including:

Counsel
  • Represented a Zorlu Group company in a large construction dispute with its Russian counterparty, and in parallel proceedings in the U.S., for an amount exceeding USD 340 mln (applicable rules: ICAC at the Russian Chamber of Commerce and Industry).
  • Represented a large financial institution in a dispute with its borrower and potential equity partner regarding an overdue convertible loan as a result of failure to implement a business plan due to COVID-19 (applicable rules: LCIA).
  • Represented a large Serbian distributor of fertilizers in a dispute with EXIAR (the Russian Agency for Export Credit and Investment Insurance) with claims concerning the client’s debt for the products supplied. The dispute was caused by Russia-related compliance in the banking system and involved proving that the parties settled the claim by other means. Applicable rules: ICAC at the Russian Chamber of Commerce and Industry.
  • Represented Renault Russia in an arbitration with its freight forwarder Ettelsoft concerning the recovery of damages, including lost profits, as a result of delays caused by improper handling of shipments from Korea to Russia and standstill of the cargo in customs control area (applicable rules: ICC).
  • Represented Codest Engineering Srl, an Italian general contractor, in an arbitration in connection with a construction dispute between the client (contractor) and its counterparty (subcontractor) under a subcontract agreement for certain works in the VTB Arena Park project, including the issues of quality of works and delay (applicable rules: ICC). One of the conspicuous points raised in the arbitration was the effect of bankruptcy on the subcontractor on jurisdiction of the arbitral tribunal.
  • Represented a Russian copper smelter in a multi-million dispute with the supplier of water treatment equipment (VOMM Implianti y Processi SpA) (Swedish, Italian, Russian law) over the quality and capacity of the equipment, resulting in losses for the customer (applicable rules: SCC).
  • Represented Fagioli S.p.A., a major company specialising in lifting and transport mechanisms, in a dispute with a major Russian-based logistics (forwarding) company arising from a contract of carriage. The disputed issues included debt, late fees, and damages, and also involved admissibility of evidence (applicable rules: ICAC at the Russian Chamber of Commerce and Industry.
Arbitrator
  • Acted as president of arbitral tribunal in a case between a Russian freight forwarder and a Turkish construction contractor regarding international transportation of heavy equipment to the Akkyu Nuclear Power Plant in Turkey. The case involved issues of settlement of the debt, repayment of a security deposit, and liability for damage to the equipment (rules and administering institution: Arbitration Centre at the Russian Union of Industrialists and Entrepreneurs (RSPP)).
  • Acted as arbitrator in a case between a Russian customer and an EU supplier arising from the respondent’s failure to supply equipment. The disputed issues involved unjust enrichment, and application of contractual liability in the context of international sanctions against the beneficiaries of the Russian customer (rules and administering institution: Maritime Arbitration Commission of the Russian Chamber of Commerce and Industry).
  • Acted as a sole arbitrator in a dispute between the Bangladeshi branch of a major Russian company and an equipment supplier. The case concerned the supplier’s failure to deliver measuring equipment for the Rooppur Nuclear Power Plant in Bangladesh. The proceedings were complicated by the respondent’s attempts to be struck off the companies register to terminate the arbitration (rules and administering institution: Russian Arbitration Center).
